User Agreement
You (the User) can access www.jurisonline.in (the site) subject to the terms of use, as changed / updated from time to time entirely at the discretion of Trikund Informatic Pvt Limited (the management) as set out below. This Agreement (Terms of Use) is for an indefinite term and you deemed have a constructive notice and agreement with teh management that you are bound by such terms (as may be changed and/or revised from time to time by the management or duly authorised representative) when you access, surf or use this site.
Changes
The Management reserve the right to add to or change/modify the terms of this Terms of Use including but not limited to suspend / cancel, or discontinue any or all channels or services at any time without notice, make modifications and alterations in any or all of the content, products and services contained on the site without prior notice. Such changes will be posted to http://www.jurisonline.in website (under the heading Terms of Use;) for your convenience. You will be deemed to have accepted such change/s each time you log on to the site and continue to access the products, services and contents of the Site subsequent to such change.
Charges
The management reserves the right to charge subscription and / or membership fees in respect of any part, aspect of this Site.
Copyright and Trademarks
Unless otherwise stated, copyright and all intellectual property rights in all material presented on the site (including but not limited to text, audio, video or graphical images), trademarks and logos appearing on this site are the property of the Managment (this term is defined to include its affiliates, assigns and associates) and are protected under applicable Indian laws. Any infringement shall be vigorously defended and pursued to the fullest extent permitted by law.
Exclusions:
1) However, all copyleft work posted on the site shall be the work in the public domain and shall be subject to the policies governing copyleft works. Jurisonline India claims no right over such matter or material.
2) The works presented on the site under sections Student write ups; corporate laws, intellectual property laws, cyber laws and any other work were the name of the author is specifically mentioned will not belong but licensed to the Mangement for publishing and the ownership of the same would be those of the authors whose names appear in relation thereto. The management takes no responsibility for the authencity or ownership of the work. Managment only holds a right / permission to present the same through the site for wider public viewing.
The Management welcomes complaints of plagarism, if any, made by the original owner of the work. The Articles published and the thoughts expressed therein are and will always be that of the authors (whose name appear thereafter).
The users agrees that in case any articles presented on the site is violative of anyone’s rights, its only recourse against the Management would be to request for the removal of the said article, on tendering substantive evidence in support of such a request. However, the discretion to remove will lie with the Management and any dispute in respect thereof would be resolved through mutual consultation and if remain unresolved shall be referred to the sole arbitrator appointed by the Management and the award passed by such arbitrator shall be final and binding on both the parties.
Permission to Copy
You may not (whether directly or through the use of any software program) create a database in electronic or structured manual form by regularly or systematically downloading and storing all or any part of the pages from this site. No part of the Site may be reproduced or transmitted to or stored in any other web site, nor any of its pages or part thereof be disseminated in any electronic or non-electronic form, nor included in any public or private electronic retrieval system or service without prior written permission. Access to and exchange of information
The Management do not permit, any part of this site being cached in proxy servers or hyperlinked to another site or server without our express permission. Requests to hyperlink caching to this site or webpages should be addressed to the following email address- admin@jurisonline.in
You may not use any deep-link, page-scrape, robot, spider; or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any content therein, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. The management reserves the right to bar any such activity.
You understand that by using such services, you may be exposed to objectionable matter. Under no circumstances will the management be liable in any way for any content, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted or uploaded on this site, except as expressly provided within the terms of this Terms of Use.
With respect to the advertisement displayed on the Site, any transaction arising therefrom which amounts to sale/purchase of goods or services not directly offered by ‘jurisonline.in’ are to be settled inter-se between the user of the Site and the advertiser (to which ‘jurisonline.in’ shall not be considered to be a party) and all warranties express or implied of any kind, regarding any matter pertaining thereto, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement are disclaimed by this site and the team of Juris Online. This site does not have any involvement in the actual transactions between the buyers and the sellers in any way.
You may not breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of the Site including any Site account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided by the Site.
You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or the system or the network, or any systems or networks connected to the Site.
You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other persons use of the Site.
You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity, wherever so required.
You may not use the Site or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of the Management or others.
This site merely endeavors to provide a web platform for various intellectual interactions, in the field of law, for your benefit and as an opportunity to express ones views is a free environment. The content posted on the site are generic in nature and hence the accuracy, integrity or quality of such content cannot be guaranteed.
If we reasonably believe that our site, web page or contents therein are being used / misused in any manner as clarified above the Management reserve the right to cancel access rights immediately without notice, and block access to all users from that IP address and take appropriate legal action, if so required.
Notice to the Freelance Writers (’Students Write ups’ and ‘Premium Articles’)
1) All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials, whether publicly or privately transmitted / posted, is the sole responsibility of the person from where such content originates (the Author).
2) The Management presume that you (the Author), as the authors and writers of freelance articles, are responsible adult (above 18 years or above) who shall be solely responsible for all content that you upload post or otherwise transmit via this site in any form or manner.
3) By using the facility of freelance writing and other similar services which is or will be offered, you agree not to upload, post, or otherwise transmit any matter or views, which are, illegal,violative of any one else’s rights (including copyright, design rights or trade marks) defamatory, abusive, obscene, invasive of another’s privacy, hateful, anti national, racially, ethnically or otherwise objectionable. You may also not indulge in cyber stalking, become or create a nuisance for any person / user.
4) You may not send, submit, post, or otherwise transmit, material or messages that contain software virus, or any other files that are designed to interrupt, destroy and negatively affect in any manner whatsoever, any electronic equipment in connection with the use of this site, or other user’s ability to engage in real time exchanges.
5) The Freelance writers hereby irrevocably agree to indemnify and hold the management, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, officers in charge, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees) (herein after referred to as ‘Liability’), made against the Management’s by any third party due to or arising out of or in connection with your use of the Site including but not limited to the liability arising from publishing the article submitted by you (the vistor/user of the Site).
Rights of the Management
The Management reserves its right to terminate its services without any prior notice for any violation of the ‘Terms of Use’.
All content posted by you (the originator of freelance articles) becomes the property of www.jurisonline.in and you hereby grant/assign the royalty free, perpetual right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed.
Disclaimer of Warranties and Liability
All the contents of this Site are only for general information or use. They do not constitute advice and should not be relied upon in making (or refraining from making) any decision. Any specific advice or replies to queries in any part of the Site is/are the personal opinion of such experts/consultants/persons and are not subscribed to by this Site. The information from or through this site is provided on ‘AS IS’ basis, and all warranties, expressed or implied of any kind, regarding any matter pertaining to any goods, service or channel, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement are disclaimed and excluded.

The Management disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the site and/or any services therein.
Your sole remedy against the Management for dissatisfaction with the site or any content is to stop using the site or any such content. This limitation of relief is a part of the bargain between the parties.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
The Management reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
Certain links on the Site may lead to resources located on servers maintained by third parties over whom the Management has no control or connection, business or otherwise as these sites are external to the site you agree and understand that by visiting such sites you are beyond the www.jurisonline.in website. The Management therefore neither endorses nor offers any judgment or warranty and accepts no responsibility or liability for the authenticity/availability of any of the goods/services/or for any damage, loss or harm, direct or consequential or any violation of local or international laws that may be incurred by your visit and/or transaction/s on these sites.
Material Submitted by Users/freelance writers
Certain elements of the Site will contain material submitted by users. The Management accepts no responsibility for the content, accuracy, conformity to applicable laws of such material.
Opinion and Drafting Services
The User of the services (Opinion and/or Drafting), acknowledge that Jurisonline.in is not a law firm or a lawyer nor are they acting as your attorney in any way. The User also expressly agrees that no attorney / client relationship exists between you and our experts and the same cannot be reproduced as authentic in any court of law in India. The Users and/or querists acknowledges and agrees that the provision of the service on the site is AN INVITATION TO OFFER and not the offer of services. Further, the management retains the right at all times to refuse to provide all or any of the services appearing on the site.
CAUTION: NOTE THE ADVISE GIVEN BY OUR LEGAL EXPERTS ON OR THROUGH THIS WEBSITE OR THROUGH EMAIL EXCHANE OR THROUGH ANY OTHER MODE OF COMMUNICATION (INCLUDING THROUGH POST OR OVER THE TELEPHONE) SHALL NOT BE ADMISSIBLE IN ANY COURT OF LAW IN INDIA OR ABROAD AND IS MERELY IN THE NATURE OF A PERSONAL OPINION AND DONOT HAVE ANY STATUTORY VALUE.

The Management reserves the right to omit, suspend or change the position of any advertising material submitted for insertion. Acceptance of advertisements on the Site will be subject to the Managements terms and conditions which are available on request.
Privacy

Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others.
Limitation of Liability
Except where prohibited by law, in no event will the Management shall be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if the Management has been advised of the possibility of such damages.
If, notwithstanding the other provisions of these Terms of Use, the Management is found to be liable for any damage or loss which arises out of or is in any way connected with your use of the Site or any content, Management’s liability shall in no event exceed the greater of (1) the total of any subscription or similar fees with respect to any service or feature of or on the Site paid in the six months prior to the date of the initial claim made against Management’s or (2) INR 500.

Violation of these Terms of Use
The Management may disclose any information it has about you (including your identity) if it determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) the Management’s rights or property, or the rights or property of visitors to or users of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to the Management and you consent to the Management obtaining any injunctive or equitable relief that the Management deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies the Management may have at law or in equity.

Severability
If any part of this Terms of Use is held to be void or unenforceable by any appropriate judicial authority having jurisdiction over such matter, such part of this Terms of Use shall stand amended or modified to the legal excepted language or interpretation. However, no such modification or interpretation is available than that part of this Terms of Use shall stand deleted for the purposes of the adjudication of that dispute alone, leaving the rest of this Terms of Use legally binding and enforceable.
Indian Law
This Terms of Use shall be governed by the Laws of India. The Courts of law at Delhi/New Delhi shall have exclusive jurisdiction over any disputes arising under this Terms of Use.
